Plaintiff says neighbor's cigar smoke invading his condominium

PALM SPRINGS -- It's an evening ritual.

Just about every night after dinner, Eddie J. Babbitt of Palm Springs sits out on his patio to enjoy a good cigar.

But Babbitt's routine in his two years at the condo complex has become the focus of a lawsuit filed by a neighbor who maintains that Babbitt's smoke wafts into his adjacent condominium, bothering him and worsening the asthma and other health problems of his live-in girlfriend.

Maryland already has several areas (Montgomery County is one) where it is an offense (as opposed to being offensive) for "Odors and other noxiouos fumes" to invade a neighbors property.
 
Cigares

Maryland has become the "land of Fruits and Nuts" thanks to the near total control of the state by the Democrats. Through their crazy laws, they have effectively banned the sale of firearms in the state. And you wonder why I am living, Very Happily, :beer: in the bottom of the Shenandoah valley???????
 
As someone with Deteriorating Asthma, I can tell you that if this chick is on her medication and more than 12-15 feet away from the second hand smoke, especially cigar smoke, it's a frivolous case. I think I heard about this one before on "another web site." If I walk directly behind a cigarette smoker I can get triggered, particularly in cold, windy weather, but it's reaching to file a lawsuit in a case like the one mentioned. And when I find myself walking behind a cigarette smoker on a crowded NYC street, I either pass them, or move out of the line of fire.
